(Oral) A mandamus is prayed for, commanding respondents No.1 to 5 to adjust Rs.5,58,402.43 (IGST), which were inadvertently deposited by respondent No.6 with the Chandigarh Department, though it ought to have been remitted to Panchkula, Haryana (respondent No.3). Or, in the alternative, respondents No.4 & 5 be directed to transfer the said amount to respondents No.2 & 3, as there would be no loss to respondents No.1 to 5 in any manner, since the petitioner is the only one suffering without any fault.
It is urged that prior to the institution of this petition, the petitioner had served the respondent-authorities with the representation dated January 25, 2021 (P-6), and even the legal notice dated February 18, 2021 (P-7). But to no avail. RAJAN KUMAR 2025.02.13 10:51 I am approving this document
CWP-7541-2021(O&M) 2 Having argued the matter at length, learned counsel for the petitioner submits that he be permitted to withdraw the petition to enable the petitioner to avail such other remedies as shall be admissible in law, as also to pursue the representation/legal notice, referred to above, with the respondent- authorities.
