Shub Conductors LLP vs. State Of Haryana And Another
Held
The Court noted that the petitioner sought a fitness certificate for its vehicle, which had been attached and blacklisted under the CGST Act, 2017. The petitioner's grievance was that the refusal to issue a fitness certificate was incorrect, as provisional attachment should not prevent the vehicle's use, and without a fitness certificate, the vehicle could not be operated. The Court was informed by both the petitioner and the State that the requisite fitness certificate had since been issued. Consequently, the Court found that the writ petition had become infructuous. No specific legal pronouncements were made on the interplay between provisional attachment and fitness certificate issuance, as the issue was resolved by the subsequent issuance of the certificate.
Facts
The petitioner, Shub Conductors LLP, sought a fitness certificate for its vehicle, registration number HR-38-Y-8201. This vehicle had been attached and blacklisted under proceedings initiated under the CGST Act, 2017. The petitioner contended that the provisional attachment of the vehicle did not legally prevent its use, and therefore, the refusal to issue a fitness certificate was incorrect. The vehicle could not be operated without a valid fitness certificate. The matter was adjourned for the State to obtain instructions. Subsequently, it was reported that the requisite fitness certificate had been issued.
Key Issues
1. Whether the provisional attachment of a vehicle under the CGST Act, 2017, precludes the issuance of a fitness certificate for that vehicle, thereby rendering it unusable. The petitioner argued that a provisional attachment does not prohibit the use of the vehicle and that the refusal to issue a fitness certificate based on such attachment was illegal. The petitioner contended that the inability to obtain a fitness certificate effectively prevented the use of the vehicle, despite the attachment not being a direct prohibition on its operation. The State's position was not explicitly detailed in terms of legal arguments, but it was implied that they were investigating the matter and subsequently issued the certificate.
