Considering the fact that the Tribunal has now become functional, we permit the petitioner to withdraw the instant writ petition, with liberty to challenge the order impugned in the present writ petition, by way of an appeal.
Writ petition accordingly is not entertained, however, in view of the fact that this petition has remained pending for substantially long, we provide that if such an appeal under Section 112 of CGST Act is filed within four weeks’ from today, the same shall be entertained without raising any objection, with regard to limitation, by the Tribunal concerned.
All pending miscellaneous application(s), if any, shall also stand disposed of.
