The petitioner has sought for issuance of writ of mandamus to direct the respondent No.1 to sanction and grant the refund claims as per the details furnished at Annexure-'A". The petitioner has also sought for issuance of writ of mandamus to direct respondent No.1 to declare the action of respondent No.1 in rejecting the refund claims of the petitioner without following the due procedure as being arbitrary and to direct the Authority to grant refund and interest for the delayed payment of refund claims to the petitioner.

Sri K. Hemakumar, learned Additional Government Advocate appearing for the respondent Nos.1 and 2 submits that the aspect of refund was under consideration and an endorsement was issued calling upon the petitioner to produce certain documents as is evident from Annexure-'B' and that the matter would be considered afresh and orders would be passed on the request for refund as per the refund claims at Annexure- 'A', as per law.

In light of the stand taken by learned Additional Government Advocate, this petition is disposed off directing NC: 2023:KHC:26302 WP No. 23405 of 2022 the respondent No.1 to dispose of the request of petitioner for refund as contained in the claims at Annexure-'A'. Such consideration is to be completed within a period of three months of furnishing of the certified copy of the order before the respondent No.
