Facts

The petitioner, Sri K.M. Sundar Murthy, proprietor of M/s. S.M. Engineers, filed a writ petition challenging a Show Cause Notice (SCN) dated December 30, 2020, issued by the Principal Commissioner of Central Tax, Bangalore GST West Commissionerate, and the consequential Order-in-Original dated December 26/27, 2024, passed by the same authority. The petitioner sought to quash these documents and set aside the demand for service tax, interest, penalty, and late fee. Alternatively, the petitioner prayed for the Order-in-Original to be quashed and the matter remanded for fresh adjudication of the SCN.

Held

The High Court of Karnataka, in this case, followed a coordinate bench's judgment in M/s. Karnataka Chinmaya Seva Trust Vs. Joint Commissioner of Central Tax (WP No.11154/2023 & connected matters dated 03.07.2024). The Court held that writ petitions challenging Orders-in-Original would be set aside and the matters would be relegated to the designated officers for reconsideration from the stage of the show-cause notice. Consequently, the impugned Order-in-Original at Annexure-B was set aside, and the matter was remitted back for reconsideration to the stage of the show cause notice at Annexure-A. The petitioners were granted liberty to file their pleadings within a reasonable time fixed by the concerned officers.

Key Issues

1. Whether the impugned Show Cause Notice and the consequential Order-in-Original are liable to be quashed and set aside, thereby quashing the service tax demand, interest, penalty, and late fee, in terms of the petitioner's primary prayer? 2. Alternatively, whether the impugned Order-in-Original is liable to be quashed and the matter remanded for fresh adjudication of the Show Cause Notice? Petitioner's Contention: The petitioner sought to quash the SCN and the Order-in-Original, and set aside the demands. Alternatively, the petitioner sought a remand for fresh adjudication. Respondent's Contention: The respondent issued the SCN and the Order-in-Original, seeking to recover service tax, interest, penalty, and late fee.
