ORAL ORDER
Learned Counsel appearing for the petitioners files a memo seeking withdrawal of the petition. The memo so filed reads as follows: HC-KAR NC: 2025:KHC:29282 "MEMO FOR WITHDRAWAL OF THE WRIT PETITION
The petitioners most respectfully submit that they had filed a joint petition on 9.8.2024 wherein petitioner no.1 is a registered society under the provisions of the Society Registration Act, 1960. The petitioner no.2 is a member in the first petitioner society.
The petitioner no.2 had challenged a show cause notice dt: 30.5.2024 (Annexure L) and summary show cause notice in Form DRC-01 dt: 30.5.2024 (Annexure L-1) issued by the respondent no.2. 3. During the pendency of the present writ petition the respondent no.2 passed an Order in No.ACCT/2.1/GST/73/32/2024-25 dt: 28.8.2024 wherein he dropped the proposals in the Show Cause Notice dt: 30.5.2024. Hence the challenge to the show cause notice dt: 30.5.2024 has become infructuous.
The first petitioner prays before this Hon'ble Court to grant liberty to withdraw the writ petition and file another petition if another cause of action arises and any member of their society approaches them in future. HC-KAR NC: 2025:KHC:29282
In view of the above, the petitioners most humbly pray that the Hon'ble Court be pleased to permit them to withdraw the petition with liberty to first petitioner to file fresh petition as stated supra in the interest of justice."
