No. 2302/2013 on the file of the Judicial First Class Magistrate's Court – I, Irinjalakuda where he faces offences under Sections 143,147, 148, 188, 332, 353, 427, 323, 324, 145, 283 read with 149 of the Indian Penal Code and Sec.3(1) of the PDPP Act. According to the learned counsel for the petitioner, he is a frequent traveller abroad; he has business interests in UAE etc., that he had applied for permission to issue passport for a period of ten years, but by order dated 08.02.2020, he was issued permission for obtaining passport for two years only.
The learned counsel has also relied on the decision of a Single Judge of this Court in Crl.M.C. No. 794/2021. According to him, in similar cases, the petitioner in that case has been permitted to obtain passport for a period of ten years.
After hearing counsel on both sides and having regard to the fact that it is a case of 2013, I think interest of
Crl.M.C.No.1300 OF 2022 3 justice can be met by issuing a direction to the second respondent to issue passport for a period of three years from today, on the petitioner making proper application. The Crl.M.C. is disposed of as above. K.HARIPAL JUDGE DCS/24.02.2022
