WP(C) NO. 11958 OF 2022 2 JUDGMENT Dated this the 4th day of April, 2022 This writ petition is filed seeking the following prayers: “(i) Issue a writ of certiorari or any other writ order or direction quashing records leading to Exhibit P1. (ii) Issue a writ of mandamus or any other writ order or direction commanding the 1st respondent to act upon Exhibit P2 after hearing the Petitioner, within a time frame that may be fixed by this Hon’ble Court. (iii) Direct the 2nd respondent not to evict the petitioner from the Shop Room No.B6 in Town Bus Stand Complex until decision on Exhibit P2 is arrived at by means of an appropriate writ order or direction.”
Heard the learned counsel for the petitioner and the learned counsel appearing for the Municipality.
It is submitted by the learned counsel for the petitioner that the petitioner has preferred Ext.P2 representation before the Secretary pointing out that the increased license fee and the GST may be waived in view of the financial difficulties faced by the petitioner during the Covid pandemic. The learned counsel for the petitioner submits that the petitioner seeks only a consideration of Ext.P2 representation.
Having heard the learned counsel for the respondents also, there
WP(C) NO. 11958 OF 2022 3 will be a direction to the 2nd respondent to take up Ext.P2 representation submitted by the petitioner and to consider and pass orders on the same, after placing the same before the Council of the Municipality also, if necessary. Appropriate orders shall be passed within a period of one month from the date of receipt of a copy of this judgment.
