WP(C) NO. 4490 OF 2022 2 JUDGMENT The petitioner has approached this Court being aggrieved by two orders of assessment for assessment years 2017-18 (November to March) and 2018-19 under the provisions of the GST laws.

When this matter is taken up for consideration today, it is the submission of the learned counsel appearing for the petitioner that the petitioner does not wish to pursue this writ petition and the petitioner may be permitted to avail statutory remedies against Exts.P7 and P8 orders. It is submitted that Exts.P7 and P8 are dated 15.11.2021 and that the period during which this writ petition was pending may be excluded for the purpose of determining the period of limitation within which the statutory appeal had to be filed.

Heard the learned Senior Government Pleader also.

Having regard to the facts and circumstances of the case and considering the submissions as above, this writ petition is closed making it clear that it will be open to the petitioner to raise all contentions against Exts.P7 and P8 by filing statutory appeals before the 1st appellate authority in

WP(C) NO. 4490 OF 2022 3 accordance with law. The period from 18.02.2022 till today shall be excluded for the purpose of determining the period of limitation within which such appeal had to be filed provided the appeal is filed within a period of one week from the date of receipt of a certified copy of this judgment.

The writ petition is disposed of as above.
