Ms Arneja Steel Trader vs. Union Of INDIA And Others
Held
The Court held that Rule 86A of the GST Rules does not permit blocking of ITC in excess of the credit available in the Electronic Credit Ledger. Creating a negative balance is considered beyond the scope of the rule.
Facts
The petitioner's Electronic Credit Ledger (ECL) had its Input Tax Credit (ITC) blocked, resulting in a negative balance. This action was taken by the respondents without prior intimation and allegedly in violation of natural justice and Rule 86A of the CGST/PGST Acts.
Key Issues
Whether Rule 86A allows blocking of ITC beyond the available credit in the ECL, creating a negative balance. Whether such action violates principles of natural justice and statutory provisions.
