ORAL ORDER
This petition under Section 482 of the BNSS, 2023 by accused No.2 in Crime No.72/2026 registered by the Kalasipalya Police Station, Bengaluru City for the offences punishable under Sections 318(4) and 3(5) of BNS, 2023. 2. Learned counsel for the petitioner/accused No.2 submits that the alleged business was carried out by accused No.1 by his brother. It is submitted that the petitioner is not carrying any business and however he was employed and he was depending on the salary income at the relevant time. It is submitted that there is no prima HC-KAR NC: 2026:KHC:25227 facie evidence to indicate that the petitioner was in the business and accepted pledge of gold from the complainant.
Learned High Court Government Pleader appearing for the respondent - State submits that the petitioner is brother of accused No.1 and both were involved in the alleged business. It is submitted that the investigation is at the initial stage and if the petitioner is granted anticipatory bail, he may not co-operate in the investigation.
Considered the submissions made by the learned counsel for the petitioner and learned HCGP for the respondent-State. On prima facie perusal of the material on record indicate that the business in the name of Riddhi Siddhi Jewellers is registered in the name of accused No.
The GST registration certificate is also in the name of accused No.
The bank statement of the petitioner/accused No.2 also indicates that he is drawing HC-KAR NC: 2026:KHC:25227 salary by working in Anand Jewellers. The salary is drawn from March 2022 to 07.12.2023. As noticed from the GST certificate at Annexure - J, the petitioner is having his own independent business in the name and style of 'Vikram Jewellers'. The FIR do not indicate prima facie involvement of the petitioner in the alleged offence. Further, the apprehension expressed by the learned HCGP can be safeguarded with necessary conditions. Further, if the petitioner is granted anticipatory bail with a direction to co-operate in the investigation, the same would not impede further investigated by the police.
In the light of the above, the following: ORDER
(a) The Criminal Petition is allowed.
(b) The respondent-Police is directed to release the petitioner/accused No.2, in the event of their arrest in Crime No.72/2026 registered by the Kalasipalya Police Station, Bengaluru City for the offences punishable HC-KAR NC: 2026:KHC:25227 under Sections 318(4) and 3(5) of BNS, 2023, subject to the following conditions: (i) The petitioner/accused No.2 shall appear before the Investigating Officer within 15 days from the date of receipt of copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh) only with two sureties for the likesum to the satisfaction of the Investigating Officer. (ii) Petitioner shall regularly appear before the Trial court without fail unless exempted by the Trial court. (iii) Petitioners shall not tamper with the prosecution witness and shall co-operate with the Police for investigation and appear before them whenever called upon. (iv) The petitioner shall not indulge iun any criminal activities. HC-KAR NC: 2026:KHC:25227 In case if the petitioner violates any of the aforesaid conditions, liberty is reserved with the prosecution to file appropriate application for cancellation of bail. (K. V.
