This Court in a similar situation passed an order dated 26.09.2023 in Crl.M.C No. 5034/2023 and the same is confirmed by the Apex Court in SLP No. 16409/2023. If that is the case, nothing survives in this case.
Therefore, this Crl.M.C. is dismissed.
