Petitioner has approached this Court apprehending recovery proceedings in respect of the demands raised as per Ext.P1 order of assessment for the assessment year 2018-19.

Learned counsel appearing for the petitioner submits that the petitioner has filed Ext.P2 appeal, challenging Ext.P1 order of assessment along with the application for condoning the delay of 215 days (Ext.P4) in filing the appeal. It is submitted that along with Ext.P2 appeal, the petitioner has preferred Ext.P3 stay application.

Having regard to the facts and circumstances of the case, this writ petition will stand disposed of, the Appellate Authority (the 4th respondent) is directed to consider and pass orders on Ext.P3 stay application and Ext.P4 delay condonation petition, within a period of two months from the date of receipt of a certified copy of this judgment. Till such time the orders are passed on Ext.P3 stay application and Ext.P4 delay condonation petition, any demands pursuant to Ext.P1 assessment order, shall be kept in abeyance.

The writ petition is disposed of as above.
